In the Preamble, We the people of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America. Preamble Each phrase in the Preamble explains why we have the Constitution. We the People refer to the rights and freedoms that belong to the citizens of the United States. In order to form a more perfect Union is in reference to the old government based on the Articles of Confederation which was limited. Establish Justice comes from the actions of Shay s Rebellion where most farmers lost their land because of war debts they couldn’t pay off. The Framers wanted to create a fair and equal justice system for all Americans. Insure domestic tranquility means the Framers wanted to keep peace with the nation’s borders. The Framers needed the states to form as a nation because there was a high risk of foreign countries attacking the United States created a new government which we needed to provide for a common defense. To promote the general welfare, the Framers wanted to show citizens how important their well-being was to the national government. Secure the Blessings of Liberty to Ourselves, and our Posterity helps protect the country s hard-earned rights for liberty, unjust laws, and freedom from a tyrannical government. Ordain and Establish this Constitution for the United States of American states that the people created and give the country its power. Since a set of regulations established to divide the powers within a government, the United States best fit the definition of a constitutional federal republic government. The Constitution divides the national government into three branches Judicial, Executive and Legislative. The Judicial branch consists of the Supreme Court, is responsible for interpreting the meaning of laws, applying laws to cases and decides if laws violate the Constitution. According to Article III, section one and two of the constitution, “The judicial power of the United States, shall be vested in one supreme Court”, and in such inferior Courts as the Congress may from time to time ordain and establish and the power of the judicial shall be extended to all law equity cases. Art III. Sect. 1 2 In the Executive branch, they carry out and enforces laws which includes the president, vice president, the Cabinet, executive departments, independent agencies, and other boards, commissions, and committees. In Article II, section one and three of the constitution, “The executive power shall be vested in a President of the United States of America” and will make sure to carry out the laws faithfully. Art III Sec. 1 3 The legislative branch proposes bills which includes Congress the Senate and House of Representatives. In Article I, section 1 and 7 of the constitution, “all legislative powers herein granted shall be vested in a Congress of the United States”, which shall consist of a Senate and House of Representatives and the legislative branch can propose a bill. Since the powers are equally divided between the three branches to make sure no branch has too much power, the Constitution sets regulations to keep power equally divided within a government. With the use of separation of powers, citizens elect people to represent them.
The United States Congress is a bicameral legislature which has the House of Representatives and Senate Members of Congress represent the people of their district by holding hearings, emerging and choosing legislation. The House of Representatives has 435 members but is based on of population while the Senate has 100 members two from each state. According to Articles I, section two and three of the constitution, The House of Representatives shall be composed of Members chosen every second Year by the People of the several States and there are two senators that represent a state for a six-year term that are elected by the people. Art. I sect. 2 3 Since the House of Representatives and Senate are both elected by the people but have different terms, the Constitution sets regulations to keep power equally divided within a government.
